This Indenture made the twenty fifth day of March in the year of our Lord one thousand eight hundred and Sixty Eight Between Jacob Steinle of Greenville township Somerset County and the State of Pennsylvania of the first part and Anna Maria Deitle of the township county and State aforesaid of the second part Witnesseth that the said parties of the first part of and in consideration of the sum of Fourteen hundred and fifty dollars lawful money of the United States of America unto them well and truly paid by the said party of the second part at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold aliened enfeoffed released conveyed and confirmed, and by these presents do grant bargain sell alien enfeoff release convey and confirm All that certain message tenement or tract of land situate in Greenville township Somerset County and State of Pennsylvania bound as follows by adjoining lands of Wm Baer Benj Lowry Jacob Garlitz heirs and others, beginning at a post north forty five degrees west 177 perches to stones from thence north 89 degrees east 97 perches to a post. from thence south 113 3/4 degrees east. 85 perches to a maple tree south 82 degrees east 18 1/2 perches to a beech thence south 115 degrees west. 81.5 perches to place of beginning containing Sixty acres and allowances Together with all and singular the buildings improvements ways waters water courses rights liberties privileges hereditaments and appurtenances and the revisions and remainders rents issues and profits thereof and all the estate right title interest property claim and demand whatsoever of the said parties of the first part, in law equity or otherwise howsoever of in and to the same and any part thereof. To have and to hold to said hereditaments and premises hereby grated or mentioned and intended so to be with the appurtenances unto the said party of the second part her heirs and assigns to and for the only proper use and behoof of the said party of the second part her heirs and assigns forever and Jacob Steinle is the said parties of the first part their heirs executors and administrators do by these presents do grant and agree to and with the said party of the second part her heirs and assigns that they the said parties of the first part and their heirs all and singular the hereditaments and premises herein above described and granted or mentioned and intended so to be wit the appurtenances unto the said party of the second party and her heirs and assigns against them the said parties of the first part and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof Shall and will warrant and forever defend.

Article of Agreement made and entered into this 3rd Day of July A.D. 1869 Between Anne Mariah Dietle of Greenville Township Somerset County and State of Pennsylvania of the first part And John Deitle of the township County and State aforesaid of the second part. Witness that she the said Anne Mariah Deitle for the consideration hereafter mentioned hath agreed and by these presents doth covenant and agree to and with the said party of the second part that she the said party of the first part shall and will sell unto her son John Deitle all her right title interest and claim of a tract of land where she now resides on ni (sic) Greenville Township Somerset County Penna Containing Sixty Acres more or less together with all the personally property adjoining lands of William Bare, Benjamin Lowry, Jacob Garlits heirs and others for the sum of Fourteen hundred dollars in hand paid. the said Anne Mariah Deitle reserves a life estate of the above mentioned property and need not give possession during her life if she don t willfully want to do so. And the said party of the second part doth hereby covenant and agree on his part that he will receive his mother Anne Mariah Deitle on his own premises in case she wishes to do so or in case of sickness and take good care of her as becomes a son toward his mother and for the time and faithful performance of the covenants and agreement aforesaid the parties aforesaid do hereby respectively bind themselves their heirs, executors, and administrators each to the other in the sum (??) This Indenture made the 20th day of September in the year of our Lord one thousand eight hundred and fifty five Between John A. Dietel of Greenvill (sic) township Somerset County and State of Pennsylvania and his wife of the first part and his son John Adam Dietel of the same township County and State aforesaid parties of the second part witnesseth that the said party of the first part for and in consideration of the sum of Twelve hundred dollars lawful money of the United States of America unto them well and truly paid by the said party of the second part at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold enfeoffed released conveyed and confirmed, and by these presents have grant bargain sell enfeoff release convey and confirm unto the said party of the second part his heirs and assigns all of two certain tracts of land situate (sic) in Greenville township said County & State aforesaid the first containing one hundred acres and allowances adjoining lands of Peter Shultz and others the same tract conveyed to Jacob Shultz by Jonathan by release dated the 5th day of November A.D 1842 Recorded in Record Book Vol 19 Page 129 and Phinias (?) Compton (?) and Aldine his wife by Release dated the 24th of November 1845 unto unto (sic) the said Jacob Shultz and by deed dated the 28 of November 1845 conveyed to Peter O. Baer, John Werner and Paul Werner all of Summit Township Somerset County Penna Annie Seichner and Andrew Seichner Henry Werner and Eve Werner of Meyersdale Borough Barbara Broud and Conrad Broud of Frostburgh (sic) State of Maryland Susan Dieddle and Adam Dieddle of Somerset County Pa legal and representatives of Elizabeth Werner wife of George Werner des of the first part and Tillie Benford of the Borough of Meyersdale County of Somerset and State of Pennsylvania of the second part: Witnesseth that the said parties of the first part for and in consideration of the sum of Four Hundred and fifty Dollars lawful money of the United States of America well and truly paid by the said party of the second part to the said parties of the first part at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold aliened enfeoffed released conveyed and confirmed and by these presents do grant bargain sell alien enfeoff release convey and confirm unto the said party of the second part her heirs and assigns, All that certain lot of ground situate and lying in the Borough of Meyersdale County of Somerset and State of Pennsylvania numbered on the old plan of said Borough as lot number Thirty seven (37) Bounded on the North by North Street, On the East by lot number Thirty eight (38) on the South by Dale Street and on the West by an Alley, Fronting sixty Six feet on North Street and running back south one hundred and sixty five (165) feet to Dale Street, Being a certain lot of ground conveyed to Henry Schrader by Jacob Olinger & wife by deed dated April 2nd 1866 and recorded at Somerset in Record Book vol. 37 page 83, said lot became vested in Elizabeth Werner only heir of said Henry Schrader at his death and by reason of the death of Elizabeth Werner wife of George Werner the title to said Lot became vested in George Werner her surviving husband and the children of George Werner parties of the first part to this Indenture. In Deed Book Vol. 256 page 97 Howard Miller and his wife Ethal V. Miller of Summit Twp. are the parties of the first part. John H. Dietle and Amanda E. Dietle (husband and wife) of Summit Twp. are the parties of the second part, and purchased land in Summit Twp. for $72.00 on Oct. 4, 1922.

 

In Deed Book Vol. 256 page 98 John H. Dietle is the party of the first part. Amanda E. Dietle is the party of the second part, and for one dollar bought The undivided one-half of those two certain parcels of ground situated in Summit Twp. on May 16, 1923.

 

In Deed Book Vol. 256 page 123 Irvin W. Fike and his wife Emma Fike of Brothersvalley Twp. are the parties of the first part. Ephriam Dietle and his wife Ida Dietle of Summit Twp. are the parties of the second part, and bought two tracts of land for $6,000.

In Deed Book Vol. 235 page 76 William and wife Christiana Dietle of Greenville Twp. are the parties of the first part. Franklin Dietle of Greenville is the party of the second part, and bought property in Greenville Twp. for $3200.00 on Oct. 13, 1920.

 

In Deed Book Vol. 283 page 23, Adam Dietle and his wife Susan Dietle of Greenville Twp. are the parties of the first part. Lloyd M. Dietle and his wife Anna M. Dietle of Greenville Twp. are the parties of the second part, and paid $6,000.00 dollars for land in Greenville Twp. adjoining that of John Dietle. It is the Same land that John A. Dietle conveyed to John Dietle by deed dated Sept. 20, 1855 and recorded at Somerset in Vol. 39 page 153 & 154 and by John Dietle the same was conveyed to the present grantor by deed dated Nov. 28, 1896 and recorded at Somerset in Vol. 92 page 505.

 

In Deed Book Vol. 303 page 158 Anna M. Dietle, widow of Lloyd Dietle of Greenville Twp. is the party of the first part. John M. Dietle and his wife Bertha N. Dietle of Greenville Twp. are the parties of the second part, and bought the home farm for $10.00 and other goods and valuable considerations, Dollars, in hand paid The deed also stated It is understood and agreed between the parties hereto, their heirs or assigns, that the grantors herein shall have the right and privilege of a one bed-room located on the south corner of the dwelling now standing on the above farm as long as either parties (Adam or Susan Dietle) shall live, they shall have free use of any part of any other part of and shall have free boarding also, during their natural lifetime. All of the furniture stayed in the house along with the livestock, farm tools, hay, feed, grain, etc. were included with the sale on Dec. 9, 1931.

 

In Deed Book Vol. 322 page 482 John M. Dietle and wife Bertha N. Dietle of Greenville are the parties of the first part. Karl F. Dietle and wife Anna Catherine Dietle were the parties of the second part, and bought property for $6,000 that was formerly owned by Nicholas Dietle on Nov. 18, 1940.

 

In Deed Book Vol. 338 page 206 on June 30, 1941 Irvin and Alma Dietle of Larimer Twp paid off a mortgage to John F. Baer, and land was transferred to Irvin and Alma Dietle. The mortgage is recorded in Mortgage book Vol. 40 page 166. The last payment was $315.00.

 

In Deed Book Vol. 305 page 310 Edgar Glotfelty of Berlin, Walter Glotfelty of Meyersdale, Charles R. Glotfelty of Oakland Alameda Calif. etc. are the parties of the first part. John M Dietle and Bertha N. Dietle are the parties of the second part, bought land in Greenville Twp. for $2,000.00 on June 24, 1932.

 

In Deed Book Vol. 356 page 355 Pete Foley and wife Mary Catherine Foley of Summit Twp are the parties of the first part. Sylvester Dietle and wife Elizabeth Dietle, parties of the second part, bought land for $100.00 and other good and valuyble (sic) considerations on Nov. 5, 1946.

 

In Deed Book Vol. 380 page 426 Karl Dietle and wife Anna C. Dietle sold land adjoining land of J.M. Dietle to M.R. Hogue for $44.50 for 3 months. It appears that Karl was living at Salisbury R.D. # 1 at the time, as that is where payments were to be directed.

 

In Deed Book Vol. 386 page 214 Harold S. Himes and Elizabeth Himes sold land to Sylvester Dietle and wife Elizabeth S. Dietle for $1.00 and other good and valuable consideration.

 

 

 

Mineral Rights Lease 168

 

This copy of a mineral right lease was handed down to a descendant of Nicholas Deitle. In those days it would have probably been the practice to have two copies of such an agreement that were signed by both parties, so that each party would have a signed copy. Certain parts of this copy of the lease are not filled in, such as the part that identifies the second party, yet Mary Deitle signed her mark to it, and the agreement it was witnessed. We do not know if any copy of this lease was ever signed by the second party. The missing items on Mary s copy may have merely been an oversight during transcription, or possibly not knowing how to read, she may not have realized that items were missing. It is of course also possible that the agreement was never finalized.

 

This Lease made this 14th day of August A.D. 1899 by and between Mary Deetle of the County of Somerset and State of Pennsylvania of the first part and _______________ (name not filled in) of the second part, Witnesseth, That the said party of the first part, in consideration of the stipulations, rents and covenants hereinafter contained, on the part of the said parties of the second part, their executors, administrators and assigns to be paid, debt and performed has granted, demised, and let unto the said parties of the second part their executors, administrators and assigns, for the sole and only purpose of mining and excavating for Petroleum, Oil or Gas, all of that certain tract of land situated in Greenville township, Somerset County, and the State of Pennsylvania bounded, and described as follows, to wit: on the south by lands of Simon Glotfelty on the West by lands of Adam Deitle by lands of Jacob P. Miller deceased and on the East by lands of George Werner Containing one hundred acres more or less.

 

To Have and to Hold the said premises for the said purposes only, unto the parties of the second part, their executors, administrators or assigns for, during until the full term of one year next ensuing the day and year above written, or while oil or gas is found in paying quantities.

 

The said parties of the second part hereby covenants in consideration of the said grant and demise, to deliver unto the said party of the first part her heirs and assigns, the full equal one Eighth part of the Petroleum Oil discovered, excavated, pumped and raised on the premises herein leased, as produced, excavated, or pumped in the crude state and the said parties to deliver the same in pipe lines.

 

The said party of the first part to fully use and enjoy the said premises for the purposes of tillage, except such as shall be necessary for said mining purposes, and a right of way over and across the said premises The said party of the second part is further to have the privilege of using sufficient water from the premises herein leased to run the necessary engines. The said party of the first part covenant to grant the said parties of the second part the right to remove all machinery and fixtures placed on said premises by them, also the exclusive right to lay and operate pipe lines to convey oil or Gas. It is further agreed that if gas is only obtained in sufficient quantities, to utilize the consideration in full to the party of the first part shall be one Eighth for each and every well drilled on the premises herein described of twenty-five pound pressure and one dollar per pound for each additional pound pressure per annum, payable within sixty days after completion of such well, and thereafter yearly in advance at Salisbury. It is further agreed by the parties hereto that the capacity of all gas wells shall be determined by accurate pressure gauge on the pipe or casing at well with all apertures from the same closed for one minute in the presence of the party of the first part or her authorized representatives. It is further agreed that if a well should be obtained so large that its capacity can not be ascertained with the escapes closed it shall be taken with them open and ______:_______ per pound thus registered shall be paid as yearly rental. Such gauges shall be taken in like manner at the end of each year after completion of each well...... computed on the above mentioned basis. Operations on the above mentioned premises shall be commenced within one year from the date hereof and be prosecuted with due diligence to completion and in case of a failure to commence operations at such time, the parties of the second part hereby agree to pay the party of the first part the sum of Fifty dollars for another year after the time commencing .............. above specified, payable at Salisbury, and the part of the first part hereby agrees to accept such sum as full consideration and payment for such yearly delay until operations are commenced, and a failure to make any such payments within such time and at such places as above Mentioned renders this lease null and void and to ............. .

 

It is understood by and between the parties to this agreement that all conditions between the parties hereto shall extend to their heirs, executors & assigns. In witness whereof, we, the said parties to the first and second part have hereunto Set our hand and seals the day and year above written.

Witnesseth, that in consideration of Twenty five hundred ($2,500.00) in hand paid, the receipt whereof is hereby acknowledged, the said grantor does hereby grant and convey to the said grantee, all that certain tract of land situate and lying in Larimer Township, Somerset County and State of Pennsylvania, bounded and described as follows, to wit:

Bittner and Johnathan F. Bittner by their deed dated the 24th day of March, A.D. 1854, and on June 10th A.D. 1867 Elias F. Bittner conveyed the same to Johnathan F. Also all that certain tract of land situate in Larimer Township, County of Somerset and State of Pennsylvania, bounded and described as follows, to wit: Bounded on the west by Jos. Bittner, on the south by land of Frank L. Bittner, on the east by Ephriam Geiger and on the north by lands of Ephriam Geiger and contains twelve (12a) acres and seventeen (17p) perches, and is part of the tract of land conveyed to Frank L. Bittner by the legal heirs of Jeremiah Bittner by deed dated the ___ day of ____ 1909, and by Frank L. Bittner the same was conveyed to Ephriam Geiger by deed dated the 13th day of November, A.D. 1909, recorded at Somerset, Pa., in record book of deeds in Vol. 221, page 286.

 

Ephriam Geiger died on the 17th day of Dec. A.D. 1919 leaving to survive him his widow Mary Geiger, and the grantor herein named.

 

It is understood between the parties hereto, or their heirs or assigns, that the grantor herein named shall have the use of the dwelling house that she now occupies, as her home as long as she shall live, and she shall live with the party of the second part in said house as their home.

MAY CONCERN:

 

You will please take notice that I, Mary Deitle, claim the benefit of the exemption laws of the State of Pennsylvania and demand that Three Hundred ($300) Dollars worth of property be set aside for my sue and benefit wheresoever found, and any person seizing my property with or without authority of law and disregarding this notice wil do so at his peril.
